Inventory of Individual Statistical Data on Migration to, from and within Switzerland in a Post-Census World

Migration flows and their consequences for immigration societies need statistical data to be adequately managed. In this context, researchers and policy makers regularly delve into original information to monitor issues, such as social cohesion, structural integration and migrants’ living conditions. The aim of this project is threefold: first, it valorizes already existing information and links datasets; second, it gathers new data through the Migration-Mobility Survey; and, third, it analyzes and diffuses those data.

Messages for Decision-Makers

The development of a longitudinal statistical database allows for a new picture of the migratory phenomenon to emerge, where migrants trajectories are analyzed in their complexity and diversity, from their arrival in the country to their possible departure.

The Migration-Mobility Survey carried out in 2016 with almost 6’000 migrants sheds lights on their trajectories, living conditions and future projects. A new round will be conducted in fall 2018.

Mapping the Demographics of the New Forms of Mobility and Measuring Their Socioeconomic Impact

This project aims at measuring the impact of new forms of migration in Switzerland by analyzing three domains: the labor market, the social insurance system and the spatial distribution of inhabitants. Using statistical methods and longitudinal analyses, as well as results from the Migration-Mobility Survey, the project reveals the complexity and the diversity of new forms of migration and mobility in Europe and sheds light on the challenges for the host society.

Messages for Decision-Makers

Challenges faced by women to combine family life and remunerated work should be carefully addressed. Deficiencies in conciliatory measures reinforce socio-economic inequalities across groups and this can be even more crucial for migrant families.

Solid migration predictions can be useful to debate on, and develop policy solutions aimed to sustain the Swiss social insurance system.

As migrants’ level of education rises, their level of international and internal mobility increases.

From “Traditional” to “New” Migration: Challenges to the International Legal Migration Regime

The Arab spring upheavals and civil war in Syria have transformed trajectories of mobility. In this context, the EU, as well as other global legal frameworks evolved, which in turn impacted on notions of identity and belonging. The 2016 New York Declaration for Migrants and Refugees increases the level of international commitment in the fields of protection, recognition, and cooperation. Yet, the questions of how the EU and Switzerland will construe admission, visa, citizenship and nationality laws and of how these levels of governance will interact remain open.

With the Global Compacts for Migration and Refugees a new legal framework is arising which is strengthening the Geneva Refugee Convention by complementing humanitarian assistance and refugee protection with livelihood creation – through access to education and employment. The locally and regionally fragmented regulatory frameworks for migrants shall be streamlined into a global undertaking.

While multi-level governance improves policy coherence, the risk of connecting unrelated policy goals might jeopardize migrants’ rights.

Recognition of citizenship as an individual right of membership on the basis of belonging instead of being the prerogative of sovereignty allows accommodating for contemporary migrant biographies.

New Wine in Old Skins? Regulating “New” Migration within the Traditional Framework – The Example of Sans-Papiers in Switzerland

According to the Swiss dualist immigration policy only highly-qualified nationals from third countries can work in Switzerland. However, some economic sectors depend heavily on low-skilled workers that cannot be recruited legally. Caught between restrictive legislative approaches, the needs of the economy and international human rights obligations States have developed various approaches to solve the untenable legal situation of Sans-Papiers for example. The project aims at developing a coherent theory on how Switzerland should approach Sans-Papiers.

The Law and Economics of Migration Policy

Migration law is not just a matter of national law. Instead, various types of bilateral and multilateral agreements come into play. It is the result of State bargaining and thus potentially linked to other issues at stake. Considering a framework of different levels of decision-making, the main focus of this project is on two questions: where should regulation take place? And how should decisions concerning different rights be allocated to individuals and to actors at several levels of government? This project uses input and concepts from economics to assess legal rules and analyze policy-making.

Large-scale developments such as new technologies, climate change, trade liberalization, or civil war bring about changes in the institutional regulation of migration.

Efficiency analysis must take into account that decisions on immigration rules may affect the well-being of people in other countries.

Spouses should be able to choose the most advantageous law governing their marriage, regardless of whether or not the couple has a close connection with the legal system that has been chosen.
