Last week, Ignazio Cassis became one of the Swiss federal councilors – after having surrendered his Italian passport in the weeks before the election. Simultaneously, in Australia several parliamentarians had to relinquish their seat, because it turned out that they had dual citizenship. Thinking about dual citizenship of elected politicians, four points are to be considered: “awareness” and the “possibility to renounce” where a prohibition for dual citizens to run for office is in force, as well as “loyalty” and “representation”, the basic arguments used when creating such prohibitions.

La rinuncia alla cittadinanza italiana da parte di Ignazio Cassis ha rilanciato il dibattito sulla portata dei diritti politici – e in particolare del diritto di eleggibilità – in Svizzera. Secondo Cassis, il suo era un atto dovuto – politicamente, anche se non giuridicamente – per essere eleggibile al Consiglio federale, mentre non vedeva nella doppia cittadinanza un ostacolo per votare e nemmeno per candidarsi al Parlamento federale. Questo episodio dimostra che non sempre il diritto di voto e quello di eleggibilità debbano coincidere.

20 September 2017: Ignazio Cassis was elected Switzerland's new federal councilor. He could have been the first member of the Federal Council with dual citizenship – if he hadn’t decided to renounce his Italian citizenship even though no legal obligation exists.

Am 26. April 2017 entschied das Bundesgericht in einem Grundsatzentscheid zur Dublin-Haft: Die separate Inhaftierung von Mitgliedern einer afghanischen Familie sowie die Fremdplatzierung der betroffenen Kinder hat das in der Europäischen Menschenrechtskonvention (EMRK) garantierte Recht auf Familienleben verletzt. Die Inhaftierung des Ehepaares im Kanton Zug lässt sich zudem laut Bundesgericht nur «knapp» nicht als unmenschliche oder erniedrigende Behandlung gemäss EMRK qualifizieren.
