Le Canton de Genève a présenté, le 20 février 2018, un bilan à mi-parcours de l’Opération Papyrus, lancée l’année passée. Le Rapport rédigé pour l’occasion donne un visage à une population qui été laissée de côté jusqu’au présent et rouvre le débat sur les opérations de régularisation des personnes « sans-papiers ».

The recent Motion for a coherent legislation concerning “sans-papiers” calls for legislative measures to further specify the criteria that should be applied in hardship cases for undocumented migrants, who have lived in Switzerland for a long time and who have “integrated” themselves, especially families with children attending school. However, is integration the only factor that should be considered in such cases, particularly when children are concerned?

À mi-chemin entre le droit du travail et le droit des personnes étrangères, la question de la répression du travail « au noir » est une thématique qui se retrouve souvent sur le devant de la scène, au gré des débats sur l’immigration et sa limitation. Si la question se pose souvent en termes « d’accaparation » du travail des indigènes par les personnes étrangères, la motion « Pour une législation cohérente sur les sans-papiers » attaque cette fois le travail au noir en tant qu’« incitation à rester en Suisse ».

Die eingereichte Motion «Für eine kohärente Gesetzgebung zu Sans-Papiers» der Kommission für Soziale Sicherheit und Gesundheit verlangt unter anderem einen erleichterten Datenaustausch zwischen staatlichen Stellen bei Personen ohne geregelten Aufenthaltsstatus, sogenannten «Sans-Papiers». Dies soll beispielsweise auch beim Schulbesuch gelten: Schulen sollen den zuständigen Behörden Kinder ohne geregelten Aufenthaltsstatus melden können.
