The Swiss experience is very instructive for the role of the free movement of persons in the upcoming Brexit negotiations. It is much easier to grasp the importance of migration in these negotiations if the control over somebody’s migration is understood as a valuable right. Brexit is the attempt to take back these rights from the European citizens without any compensation in turn. Most probably, that will not work out.

Tout va mieux dirait-on ! Le front des migrations encore bruissant d’angoisses il y a un an s’est soudain détendu en Suisse. L’UDC a d’autres soucis cantonaux, les demandes d’asile comme le solde migratoire sont – un peu – à la baisse, le Brexit pourrait même offrir quelques avantages…

Die Schweiz stellt humanitäre Visa für Flüchtlinge aus. Nun hat der Europäische Gerichtshof EuGH mit seinem Urteil «X und X gegen Belgien» entschieden, dass die Ausstellung von Schengen Visa für die legale (und sichere) Einreise in die EU rechtswidrig ist. Anderer Auffassung war der Generalanwalt Paolo Mengozzi, der eine gegenläufige Interpretation der Rechtslage forderte.
